The Freedom of Information Act (FOIA) law was passed on the belief that people should have the right to full disclosure from government agencies. Except in situations where national security or personal privacy might be compromised, U.S. citizens, green card holders, and foreign nationals may request a copy of their USCIS file.

There is no central government office for processing FOIA requests, so it is important to know which department- Department of State, Department of Labor, or USCIS- can handle your particular request.

Prior to filing any petitions or applications with USCIS or U.S. Embassy abroad, it could be useful to request a copy of your immigration file. Any foreign national, U.S. citizen, or green card holder is within his or her rights to do so.
